He may request to pay a fine, the city/state to hold the conviction on the citation from his record and to take a defensive driving course.  If he is allowed to do this, he will not have the conviction; therefore, he will not receive any points on his record.  He may request this prior to court or in court.  Usually, one should be able to do this without an attorney.  However, it does not hurt to have an attorney present.

Well, the ticket came with a $76 fine and 2 points. I don't care to pay the $76 but I do want the points removed. Do you think that if I pay the ticket the points will be removed?

Request this in writing prior to paying the ticket.  I know you do not want to give your money away.  Also, ask for a reduced fine.

First, I'd liked to thank you for taking the time to give us your advice. Tomorrow we will go to the magistrate office. If they don't allow us to take a defensive course before trial to avoid the points, we can use your services. What would be the cost of this?
