Customer: At the intersection of Robinson Rd & McDermont at Plano TX, before I entered the intersection the sun blinded me. I tried to use the panel on my car to be able to see but it was too bright. I could not see the color of the lights. I was on the third left lane of the road. As I crossed blinded, I slowed down as I saw cars coming in from Robinson Ln from my left. I was able to avoid hitting one car then the next one hit me. I never hit anyone, I have many years with out an accident or a ticket on my record. I stopped on the right side of the road after the intersection and call 911. Also, the police officer told they will investigate and press charges if they find anything. Is it possible I get charged in an accident even if it was unintended and I did not injured anyone?

Although it is possible in some cases to have found criminal negligence, from what you were telling me, your situation would not be a case of criminal negligence.

Criminal negligence involves the wrongdoer’s intention to act in a way that will result in harm. Here, there was no intent to do harm or gross recklessness. And no one was injured. So it is very unlikely that a district attorney would file charges.

should I just focus on contracting an attorney to dismiss my ticket?

You could attempt to dismiss the ticket however a ticket is different than a criminal charge. It is doubtful that you would be able to get out of the ticket itself even if the sun was in your eyes. What I was saying is the incident is not something that would be or where a district attorney would file charges against you. Still, you can attempt to dispute the ticket. It would be up to the judge to decide.
