Customer: I had filed a claim 2 months ago, and I had an adjuster come out give me how much the damage was. But when I filed I told them I was doing deliveries and the filed, and I didn't know they didn't cover "commercial" Which I don't believe is okay cause it's my personal car and it was my job and I was just stepping in for a driver. I just found out, after 3 weeks of trying to get a hold of them that it was denied and after it has been in the shop taken apart. I'm not sure what to do
JA: What state was this in? And have you consulted a local attorney?
Customer: It was in North Carolina, and no I haven't I just found out yesterday
JA: Was a citation issued? Was a court date set?
Customer: No, neither of those.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No Ma'am

Under a common law torts theory, an insurer owes its policyholders a duty of good faith and fair dealing due to the special relationship between the parties. Proving a bad faith in many jurisdictions generally requires the policyholder prove two elements:

1. Benefits due under the policy were withheld.

2. The reason for withholding benefits was unreasonable.

So if you believe that is the case, then you may want to meet with a local attorney to review your policy and your claim. If they are acting in bad faith, that can potentially result in punitive damages. But even without bad faith, you may be able to sue for the coverage. But you will need the case reviewed. You can search for a local attonrey by visiting www.justia.com.

Does that make sense? Did you have any additional concerns or need me to clarify anything related to this?

Customer
I think I got everything. I just don't think with held is what they did. They did say I was covered never mentioned that my coverage never covered people using it for deliveries like dominos and other places, which I think is not accurate with how it's worded, they commercial use, but this is my personal car, and I was covering for another person, I'm just flabbergasted how that even works. And then took my coverage back and only sent a letter, which I never got to explain. I would like to sue them, but I just got unfairly fired from my job before I heard the news about my car. But I suppose I could try, but money is my only issue

I am sorry to here that. If the case is strong, the lawyer may agree to a contingency fee where you pay from a verdict or settlement.

Customer
That would be nice, hopefully it will be
