I bought a car cash, but have not picked it up due to an agreed upon and signed repair that the dealership agreed to.

Expert's Assistant chat
Customer: I bought a car cash, but have not picked it up due to an agreed upon and signed repair that the dealership agreed to. Now they are saying they can't fix it because it's not what they thought it was. What is my legal standing?
JA: What state are you in? And is a local attorney or other consumer protection advocate helping with this?
Customer: I'm in Texas. No, I have not asked an advocate or anything yet.
JA: Have you contacted the seller or manufacturer?
Customer: They contacted me and told me that they can't fix the back latch to the gate. That I would have to crawl in from the inside and slide a flat blade screwdriver into it.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No

I will try to do my best to answer your question. While we are working together, you might experience a wait time. This is because I am working with more than one customer at the same time. Even if it takes a little while, I promise I will respond when I am able to. Thank you for your patience.
.
I am sorry to read about your uncertainty and I hope we can address the matter here.
.

I have read what you wrote. I can try to respond, but I need some additional information first. Please answer all of the following questions, by number:
1. Who did you buy the car from?

2. Can you explain what yu mean by "agreed upon and signed repair"?

I need your answers to each of these questions before I could respond further.

Customer
South Texas American Auto. I had them state and sign in the contract that they would fix the back gate of the Chevy Tahoe.

Okay.

1. You also said that they are saying they can't fix it "because it is not what they thought it was."  What do you mean by that?

2. What EXCATLY does the agreement say about their responsibility to make the repair?

Customer
when when I asked them to fix it, they said it was the back latch. Then they said they ordered the part but there is no power getting to the the back hatch so they can't fix it. So it says in remark: "We will fix latch on back hatch - Nicole W"
Customer
They called me and said that I would need to open it from the inside. Well, then how can I put things back there? I would always have to not block where the screw-driver hole is now to pop it open.

I don't quite understand the situation.  But the bot***** *****ne is they are obligated to do exactly what they agreed to do, which is to "fix latch on back hatch."   If they fail to "fix latch on back hatch," you could hire someone else to do it and then sue South Texas American Auto in small claims court for the amount it cost you to repair it elsewhere.

.

Here is a link to some helpful information regarding small claims court procedures in TX: https://guides.sll.texas.gov/small-claims.

.

Have I given you a satisfactory response?

Customer
One last question that I thought of. So what if they did actually do the repair on the latch, but since there is no power going to the back gate then the latch doesn't work. They "technically" fixed the latch. It just turns out that it wasn't the entire problem.

Well, then it would be up to the judge to decide what "fix latch on back hatch" means.  The judge will have to decide what you and South Texas American Auto had in mind when you entered into this agreement.

.

Have I now given you a satisfactory response?

Customer
Thank you.
