Hi.My son got into an accident yesterday. There was a vihicle that hit a tlephone pole and ended up on his side of the road, he swerved after turning the corner to avaid hitting hime and ended up going to the site of the road and hitting a tree. Can I go after the other person forblicking his lane and causing him to swerve?

I am sorry to hear of this issue. Your son will want to make a claim against the person who swerved to their insurance company. They will do an investigation into the accident and determine who was at fault. If the insurance company determines that it was their insureds fault then they will offer to settle the claim. If they do not then you son would have to sue for the damages. He can sue in small claims court for up to $7k in his state. If he needs to sue for more, he would sue in state court which is a similar procedure, just a different court.

You can do this by going to your local small claims court and filling out the complaint packet. You will then file it and serve it on the other driver. The judge will then hold a hearing to determine liability and damages.

If at anytime you need an attorney to assist you, you can find a local attorney by contacting your local bar association and asking for a referral to one. You can also contact your local legal aid society as they offer free and low cost services in these types of cases. Another good resource is to contact your local law schools as they often have clinics with attorneys that will assist in these types of cases. Again, I am sorry to hear of this issue.
