Customer: I live in an HOA. I had to file a claim against the HOA this past year. I won the claim. The board members resigned and their were 3 seats open. I applied and I am now an HOA board member. The previous HOA board legal representative, Jason Grosz, is still the attorney. I feel this is a conflict of interest. He not only insultes my intelligence but was rude and disrespectful to me multiple times. My own legal counsel stated that he was taking it "personal" rather than separating me from the claim. I have stated it is a conflict of him to legally represent the board at this time and he needs to honorably recuse himself. Another new member who wasn't involved in the claim is stating its not a conflict of interest. He is not privvy to all the interaction and there was a confidentiality agreement put in place. I do not feel Jason can represent me based on my previous experience with him. Since I feel that way and it has been stated I feel that way, does he have to recuse himself from representing our HOA board?

I was forced to file a claim against my HOA. Cousel for the HOA board members was incredibly rude and disrespectful to me, even insulting my intelligence via email, prior to my ability to retain cousel. My attorney advised that opposing counsel had crossed the line and made it "personal." I ended up winning the claim in mediation. All the board members resigned and I applied to be a board member this month. As of a week ago, I am a new HOA board member. There are 3 of us. 1 is a former board member who reapplied, myself and Will who is also new. I stated the HOA board attorney was now a conflict of interest for me and I wanted to retain a different attorney to represent the boar. Will who was not involved in the claim, says its not a conflict of interest. I don't understand what grounds he has to even comment. Is it fair for me to request the HOA attorney honorably recuse himself from representing our board citing conflict of interest? Thank you.

It is not a conflict per se but you can ask for a new attorney because you do not get along
