Customer: i am coming up on the closing date of my father estate. Can I get an extention on the closing date and if so what do I need to do at what costin the state of DE.
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: Just opening. I had a few setbacks this past year which I could not proceed.
JA: Have you talked to a DE lawyer about this?
Customer: yes, and it seems when I took over last year as executor in 2021 the year before when my father died, my stepsister was able to get all stocks and retirement and distribute it with family members in 2020.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I had ample time is there time to extent the closing date? this is the first I had time to pursue. I need help.

Thank you.  So long as the representative complied with the accountings it is permissible to extend probate. No extension is required unless the judge gave an anticipated closure date.  Please see https://delcode.delaware.gov/title12/c023/sc01/index.html

You can file a motion for extension of time and include an affidavit stating the reason it is needed.

If the court clerk does not have a preprinted form it would need to be custom drafted on pleading paper. You can find templates at the law library or possibly online.  Some will choose to have a lawyer prepare it but that is more expensive.
