Customer: I have a view fence and I live in an HOA. It does not address it I. The CC and R's. I put in a request to use bamboo Reed on the view fence for privacy reasons and to keep my dogs in. I just heard back saying the bamboo is not allowed, that there was insufficient reason, instead to plant plants to add privacy. Isn't this violating my arizona intrusion law and my right to privacy? Plus it's not in the cc and r's I was given by the builder when we built.
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: We sent in a request to the architectural design office and they responded.
JA: Have you talked to an AZ lawyer about this?
Customer: No.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No.

The HOA can restrict bamboo fences if it has such a restriction in the bylaws.

What if there is no mention of view fences in the bylaws

Then they have no authority to prevent these kinds of fences.
