Yes, you can sue him for fraud, negligence and breach of contract. I see several claims. It would be small claims or civil Court depending on the amount in question. I would send him a letter demanding what you want and setting a dead line. You can also potentially get a new expert in there to repair the issues and sue for those costs as well.
