Customer: I own a historic house in an established preservation city district. Our city preservation commission has recently started enforcing the US Dept of Interior standards where in the past we usually were approved if we met a "drive by" standard that maintained the character of the neighborhood. what is our recourse in maintaining the less rigid standard we have been allowed to use for 30 years. The motive for changing seems to be to justify federal funds for various projects usually city wide and not specifically benefiting our neighborhood. We have not tax incentives in our neighborhood.
JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: We have started a protest in the last two public meetings. We were able to get the commission to withdraw a harsh new regulation proposal that among other things was going to impose criminal penalties on the homeowner if they failed comply with their rulings. We have been praised a few public comment meetings for us to be heard. We have hired a local lawyer who, while well respected, has no direct "preservation" experience.

It could be further argued that homeowners relied on the present law in purchasing their homes and that any substantial changes would therefore be inequitable and that any costs associated with those changes should be born by the city that seeks to impose those changes.
