Customer: I was a waitress, and my boss asked me two weeks ago to train a Japanese boy who can barely speaks English, I was being very patient to him, yet he told my boss that I was being impatient , my boss told everyone in the restaurant then told me to look after the boy like a mother, and didn’t say anything to the boy. But he knew very well how I trained the boy. I was humiliated and angry so I left the company without giving any notice period, we only talked to each other through email, and I don’t sign any contracts or arrangements except for applying for the tax code. Now my boss accepted my resignation but he said he needs to talk to his lawyer. I’m scared now
JA: Have you discussed this with a manager or HR? Or with a lawyer?
Customer: no its a small restaurant
JA: Are you an "at will" employee? Do you belong to a union?
Customer: What is an at will employee? No sorry I don’t belong to any union im an international student
JA: The Employment Lawyer will be able to walk you through that. Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: no that’s all, thank you

Your employer cannot do anything to you for leaving without notice. He cannot sue you or fine you for leaving. If you did not have a written employment contract, then your employer can be fined, so he is most unlikely to do anything.

Does it mean that the conversations through email doesn’t mean anything?

What were the conversations about? Has he threatened you?

Customer
No he just told me through email to come to the trial ( I was paid), then gave me the roaster. I’m not sure if that’s another kind of employment agreement.

What I was ver angry about is this new staff is 30 years old, and my boss is a middle-aged man, I’m only 24, yet he told me this new staff is a very old-fashioned Japanese guy who is extremely sensitive, and wanted me to treat him like he’s my son, it was a very strange request. Does that mean he wants me to protect the new staff’s man dignity while being disrespectful to me? Because both of them are Japanese and I’m Chinese? I don’t know honestly. Especially when he knew very well how I treated the guy, he told me I was a amazing teacher, but when the guy complained, he didn’t tell the guy it was him being too sensitive, but demanded me to be more gentle, like a mother. It was ridiculous, he told every staff in the restaurant, and made it seems like I was the bad one. I was afraid it would become a bully event, so I left immediately.

He called me 5 times, but I ignored his phone calls. I just sent him my resignation letter, and I responded to one of the senior staffs. He then emailed me saying he needs to talk to his lawyer about me being absent for my last few shifts, and didn’t give him any chance for negotiations. can I see that as a threat? Coz he knew he didn’t give me any kind of employment contract, so his lawyer can’t really help him in any kind of way. I was extremely anxious when I first received his email, and I cried several times to my family and friends…..not to mention how he tried to make me seem like the bad one in the whole thing.

He may be trying to avoid giving you his last pay, but there is nothing he can do to stop you leaving.
