On the site we give general advice rather than specific advice on a contract. I suggest you look at the documents and the situation and ask me some questions about things that you do not understand
Customer
I have a question regarding business
Customer
I signed with an agency to help in business and I gave 30 days notice to discontinue with them
Customer
They're saying that because two payments didnt go through on the payment day - but have been cleared that I have to continue to pay for an additional four weeks but this isn't stated in my contract. since looking through my contract I cannot find where it says that

If it isn’t in your contract, then you should not pay. If there is some small print about this you need to read the contract carefully just to be sure

Customer
I have read the contract and it doesn't mention it. i don't know if you look over contracts. the account emailed me and said its their right to do so.

Does the contract give you the right to cancel?

Customer
in additional clauses it states "if the client does not give 30 business days notice for stopping payments after the 30 weeks. This will roll into a new set of 30 weeks. Meaning payments will continue for that period of time."
img

Chris The Lawyer, Expert

That is a tough clause and would mean a rollover if you do not give proper notice. However that does not mean you have to pay extra once you have given proper notice, even if a payment was missed or late

Customer
I gave more than 30 days notice as I knew I didnt want to continue. payments that had been missed on Friday were cleared up by Monday.
Customer
Im unsure what to do next.
Customer
when they're saying that its there right

You can have an option of telling them that you can contest this in the disputes Tribunal. Even if they are trying to make you pay the money, if the claim is for less than $30,000, you can ask the disputes Tribunal to make a ruling over whether you are liable.

Customer
okay. Should I go to the Dunedin Community Law Centre?

Yes, they could help

Sometimes less scrupulous training organisations can do this. They try to bully people into keeping their contracts but you have obviously decided there is no further value
