Customer: My husband had a workplace accident and it has caused permanent damage to part of his body.Acc is paying weekly payments. His employer has paid out the 1st and some of the 2nd week but have told him that he can use his sick leave and that he should be okay giving ACC is paying 80%. We informed his employer that he does not want to take his sick leave and that they should accept onus for his injury and pay 20% or come to an amicable arrangement as we cannot afford to lose 80% and that loss of income was something out of his control. Is there anything we can do to get some form of compensation?

The standard payment under the ACC scheme is 80% of his wages. If the accident was caused by a health and safety issue then his employer could be prosecuted and compensation paid. This would need to be a prosecution by Worksafe. But that is all he can claim. He may be better off using the sick pay to top up the payments if they have offered.
