Customer: Kia ora, we have solar panels installed by Harrison eight years ago. It has 10 product warranty. However, recently we have leaks coming into our house. A builder came and found out the the joints that the panels that were installed into the roof were not installed properly causing slow leak and causing damage to our ceiling etc. I contacted Harrison to come and check the solar panels and installed right and fix the leaks. However, they are not responding and asked us to contact our insurance company. Our insurance company said it is a slow leak and we cannot claim. We have a roofer who confirmed the leaks are due to poor workmanship from the installation of the solar. Harrison is not going to come and fix the solar panels and we have waited 3 weeks now. What are our options? We just want them to come and fix take the solar panels out, check all joints and put them back right. The builder does not want to touch the panels. What are our options? We feel that Harrison should come and put things right as they have given assurance that there will be no damage to the roof. Thanks.
JA: What state are you in? It matters because laws vary by location.
Customer: I am in New Zealand.
JA: What steps have you taken so far?
Customer: We have asked a builder to come and check, and roofer confirmed the issues are from Harrison's installer, contact our insurance company who has sent report to Harrison insurance confirming damage to the ceiling etc is due to slow leak.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: We want to know who should be liable for the damage and pay for the repair. thanks.

You are entitled to expect a proper standard or workmanship under the Consumer Guarantees Act. If the installer will not do the repairs, then you should place them on notice that you will get someone else to do the repair but make them pay

Customer
What if they refuse to pay? Also, the damage to the ceilings - who should pay for these damages?
Customer
If they don't pay, do I take them to disputes tribunals? thanks. Who is liable for the damage inside the house due to the leak?
img

Chris The Lawyer, Expert

You can claim in the Disputes Tribunal, and also claim for the consequential losses for the damage to the house

img

Chris The Lawyer, Expert

The limit in the Tribunal is $30,000-will that cover the losses?

Customer
I don't think it will cost that much at all. Can I go to fair Go?
img

Chris The Lawyer, Expert

You can, sometimes naming and shaming works

Customer
Thanks Chris. Just to clarify even though the solar panels were installed eight years ago, we can still get them to come and fix the problems which exist during the installation?
img

Chris The Lawyer, Expert

There is a long limitation period of 10 years under the Building Act

Customer
Thank you so much. I shall contact them again to get them to put things right. If they keep delaying and refusing to do anything, I will go to dispute tribunal and also try and find another company who may be able to re-install the solar panels correctly, get the quote for repairing the house and send them the bills. Is this the right procedure?
