Customer: My tenant is $1300, in over due rent, she has notice to move out on December 11th,. She was paying $250 per week but I put it down to $200 in order to give her a chance to catch up. She has not done so and is now threatening me with the tribunal because the place is not insulation underneath,. My daughter is moving in in December so this was not legally necessary,. The rental was short term only to help someone out. I have given her written notice,. But this week no rent again,. It is a 3 bedroom bungalow. With good heating and a setback connected to hot water system. We are in bluff and now her brother has moved in

Customer: Excellent, it was used as a bnb bringing in,$200, average per night,. Very clean tidy house, with brilliant views was advised I should be getting at least $350.
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: Spouses to keep lawns mowed and garden tidy,. Gardens a mess, now taking curtains etc and changing around, she is alcoholic with a 13 year old daught I felt and still very sad for both of them,. But I am in my ,70's my husband has Alzheimer's and this can't go on.

If she has fallen behind this far in rent, you can apply to the tenancy tribunal to have her evicted for failure to pay the rent. You can apply to the tribunal online, or if you are not comfortable with using the online system, you could file an application at the Invercargill district court, where they will put this in the tenancy system. Although there is a requirement that the property should be insulated, which came into force on 1 July this year, if otherwise the property is suitably warm using other systems, this should not be a problem

I sorry Chris I had a small crises with my dog yesterday and was unable to respond. i will go to the tennacy tribunal at the courthouse and file a application as soon as I can. i am hoping it will be open today but I will at least call them. I understand about the underfloor insulation but the house is very warm, I lived in it for 6 years and as a bnb people were very happy with it. I do believe she has access to wood to burn in the yunca if she really wanted to but she appears to be drinking a lot and not functioning very well.

dang that went off before I meant it too. Her brother moved in so he could repair the gardens which are a terrible mess with the assumption that he would have free rent in return. He is working and has a good driving job. Nothing has been done so far. anyway thank you so much for your advice it has been very helpful and I will ring the courts later today
