Customer: Morena. My 2 daughters have been living with their mother for the past 5 months. Prior to that they were with me for 2yrs? this has been a trial period with their mum and is to be reassessed at the end of the year. We have a parenting signed arrangement done before the girls left in January 2021. Their mother has decided to relocate back to Tauranga in 2 days and is enrolling them in schools without any type of communication with me. I live i in Tauranga so the kids coming home suits me to a tee but I had to find out from my 12yr old that they were 1. Moving back to Tauranga and 2. being put in schools without my knowledge. Can you help? What are my options?
JA: What's the reason for the relocation? How much advance notice has been given?
Customer: I don't know why they are moving back? There's been no notice. I was told by the kids mum yesterday that they'll be back this week
JA: Has there been any mediation on this issue?
Customer: No.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: Its been a long drawn out process that gone on close to 5yrs???? I'm just over it and intend on bringing the kids home at the end of the year once the agreement is ready to be recessed

Morena Chris. I live in Tauranga atm. As of January this year 2 of my daughters have been living with their mother Tilly in the far north on a trial period until December this year where it will then be reassessed. On sat 29/5 I rang my daughter Tira (12) like I do most weekends and she told me they are moving back to Tauranga, then she tells me her mum is enrolling her in Tauranga Intermediate and my other daughter Tawhai in a primary school in Tauranga. I'm stoked that my babies are coming home. I'm not happy at all though at the fact that Tilly hasn't informed me of the relocation or talked to me about which schools the kids will be attending once they come back until yesterday. I've had day to day care of all my kids for the last 3-4 years, I own my home, the kids were leaders in school, they were settled and all doing well. After 5 months living with their mother they haven't been to school. Tilly was supposed to get an exemption and home school them which she didn't now after 5 months she's relocating them re-schooling them, not informing me of any changes and I'm sick of it. I need help. I intend to get my girls home and settled once this 12 month trial with their mum is done and get my girls back on track. Can you help? Nga mihi Mike.

This doesnt appear very good. Schooling should be a guardianship issue, which she must consult with you. While it is good that she has returned to Tauranga, she should have asked you about the schools. This would mean you can apply for parenting orders especially in the light of the children not attending school or getting home schooled. You could try further mediation first of course

If you want the children to return to you, then you should open a dialogue. It seems the Far North adventure may not have been a great success. So a discussion about this with Tilly would be a good start. But the girls best interests are the key, and if that means returning to you, then that should be your next step
