Chris The Lawyer, Expert

Hi
I am a New Zealand lawyer based in Wellington and will help you with your question today. Please give me a minute to read the question

Chris The Lawyer, Expert

The Official Information Act gives members of the public the ability to request documents held by government agencies. The Privacy Act sets out a code for dealing with private information held by anybody, and how that can be accessed or used or protected. If you have a specific question I can help with that

Customer
does oia include personal information that is not in the privacy act information?
img

Chris The Lawyer, Expert

It may have information which is not about you but about government action on something which you are interested in.

Customer
who do you ask for oia or personal information to the minister of the government?
img

Chris The Lawyer, Expert

You can ask for either official information or information held about you under the privacy act and codes. Normally you would ask from the agency you are dealing with, and if that agency does not cooperate, then you can ask the Ombudsman to intervene for official information requests, and the Privacy Commissioner for privacy issues. To some extent these do overlap

Customer
can you ask for your information from the minister of government?
img

Chris The Lawyer, Expert

You can, but it's usually to the department you are dealing with. The minister would refer your request to that department in any event

Customer
whats the difference between the police vetting information and the information under the privacy act from the police? can you ask for police vetting information yourself?
img

Chris The Lawyer, Expert

No, the New Zealand Police Vetting Service is only available to approved agencies.

img

Chris The Lawyer, Expert

  • The Police Vetting Service does not provide vetting checks to individuals.
  • If you require a Police vet for employment or volunteer work involving children or vulnerable people, the agency employing/engaging you will need to submit a vetting request to us on your behalf. The results of the vet will be returned directly to the agency.
  • If you require a copy of your Criminal Record, you can obtain this from the Ministry of Justice(link is external), which also contains information about differences between a Police vet and a Criminal Record Check.
Customer
there has been a number of student loan arrests at the airport . Does that mean IRD has asked the court to issue a warrant of arrest in case? Does police help IRD in any way?
img

Chris The Lawyer, Expert

IRD ask the court to issue a warrant and the police use the warrant to arrest the person
Customer
Does IRD use debt collection agency?
img

Chris The Lawyer, Expert

No, they handle this themselves
Customer
Does IRD use debt collection agency or does it use people that do the community work for their offences?
Customer
how can you find out if warrent for student loan has been issued?
img

Chris The Lawyer, Expert

They have division who handle collections. You cannot find out about a warrant because it is something that is confidential
Customer
