Customer: Good morning, I just want to ask a simply question, and how much it will cost?
JA: It's just a small, refundable fee for a 7-day JustAnswer trial. After that, it's a small monthly membership fee. What state are you in? It matters because laws vary by location.
Customer: I am living in Auckland, and I want to ask about tenancy law
JA: What steps have you taken so far?
Customer: sorry, what is that mean? I did not take any legal steps
JA: The Lawyer will be able to walk you through that. Anything else you want the Lawyer to know before I connect you?
Customer: yes,

How may I help-can you describe the issues?

Customer
Hi Chris, here is the hold story,
I signed the tenancy contract on 23rd Feb with the agent. The agent told us after we move-in we have to negotiate with the landlord on anything. The landlord said he wants to sell the house after we move in, and need to do open home, Auckland was in a three days Level 3 lockdown at that time, we were feeling unsafe for open home. He did not disclose his willing to sell the house before we move in. then he called us say if we do not allow him to do open home he need us to move out early, like a early termination of our fix termed tenancy contract till 23rd May. The early termination will be 21st March, we have agreed to move out. The landlord also say the bond will not be his business anymore we have to communicate every thing with the tenancy service.
Customer
Our question is this, now we have two and half weeks left in this renting property. I want to ask if we can stop paying the rent for the next two weeks, but instead we want to pay via a bond split. Because we think the landlord is very NOT trusted.

You did not need to move out without 42 days notice. If you got that much notice then he needs to sign off with Tenancy Services to get your bond released. Otherwise you would need to apply to the Tenancy Tribunal to get this released

But you could just stop paying the rent as you suggest because you do not trust him to release the bond

Customer
am I legally to stop paying the rent now?
Customer
got you, also I have another question, I want to make a complain to tenancy tribunal for the landlord, but I don't want to go to the hearing, Can I just make a complain about this?
img

Chris The Lawyer, Expert

If you want to make a complaint you would need to go to a hearing so just making a complaint may not be much use

Customer
got you, thank you so much Chris. Very helpful information.

Ok, glad to help

Customer
the landlord did not disclose that he wanted to sell the apartment before we moved in
Is he doing this illegally?
img

Chris The Lawyer, Expert

He should have told you that

Customer
