Expert's Assistant chat
Customer: Hi Pearl, I am about to sign up with a Maori Organisation in as a youth coach for young people whom have been referred on to me by Police and Oranga Tamariki? I have my own programs that I want to introduce but am worried that the organisation may take them as thier own. How do I protect my IP?
JA: What state are you in? It matters because laws vary by location.
Customer: I am in Gisborne New Zealand
JA: What steps have you taken so far?
Customer: I have been designing programs for the last 20 years for youth. In the last four weeks i have designed a program specifically for this role. At my interview thier were aspects of what they do that are part of my program but there is many differences.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I want to know two things. First how to protect my IP and secondly would it be better to go on a contract or as thier employee?

The best step may be to ensure that on all your written material you include something like Copyright Asserted by (your name) at the foot. Then if you find that material has been copied and used by others you can stop them and claim d amages.

As for the choice of contractor/employee, it depends on whether you want more freedom, and the bother of doing your own tax, but with less security. A contractor can be easily dismissed but an employee is much harder to dismiss except for cause

Customer
Thanks Chris. so just by writting Copyrigh Asserted and my name in the footer would make it a legally mine?
I agree I would rather be an employee and be a part of the organisation. They have been known to take other peoples ideas then let the person go and hire a family member to take over the program now that it has been written up. So I am being careful about my next steps before signing the line.

It is legally yours if you are the author, but adding the annotation just reminds people. So hopefully the employer will respect that more if it is obvious

Customer
That is great advice. Thank you very much Chris...have a great day
