Customer: I am stuck in the middle of a dispute between two other parties as i was offered to use a dog as stud duty to my two females, the agreement was a pup back from each of my litters as payment of stud fee to the person who contacted me and made this arrangement, then later on down the track after my girls had been bred and pups born the original owner has come forward by means of an email to me claiming to own the stud at the time the mating took place.

Are the dogs registered as pedigree dogs? Have you seen any council registration papers?

dogs are registered as pedigree dogs under a kennel name with a kennel club. The microchip chip number still shows under previous number up until today, and i have been presented with the dispute conversation between 3 parties talking on a messenger group showing there is clearly a dispute.
Its not fair that i am in the middle and turning my life upside down..? And the person i dealt originally never disclosed any if this info that she was ever in a dispute over the ownership of the stud, now this lady has contacted all the pup buyers threatening no registration and caused my name to be slandered in the french bulldog community of NZ, i believe i should have rights too and what’s happening to me is unfair - im seeing a doctor today due to the bad stress this has caused and sleepness nights , no going to work for 3 days - causing me huge stomach upset and burning.

I had arrangements to meet the lady in question to give a pup over this last saturday, the day before spot on timing I received an email from the claimant to be the owner of the stud dog at times of mating and advised me they make claim to the full stud fee, therefore i was advised to not meet her and ask she sort out her dispute and show me proof she is the righful owner, this proof has still not be given to me, the pups are all needing to leave the nest to go to there owners - of which a few have already, so now for the people who have purchased pups they are getting giving this info putting doubt in me ( where ive been stuck in the middle and not fair for me to be here ) and the pups meant to go to the rightful stud are on hold and their life needs to be put in hold too, i have offered to pay either party ( in email i sent both ) once dispute settled and i have received proof thereof, however the lady i had the arrangement with is claiming i had a contract with her and she wants the pup now and it threatening legal on me, she does not wanto sort out her dispute.

Would a a mediator be a good option? Getting an independent neutral mediator would enable all the parties to sit down and talk through the issues and sort this out

I have suggested they sort this out, they have been arguing about this for more than 5months, of which i was never made aware.
What are my right??
Should my rights not be important here?

I should have been disclosed this argument from the start?
I am the one willing to pay the rightful owner and said this to all parties verbally and on email.
Although it leaves me in the middle. I need to know what my rights are as i have been falsely accused now and name getting dragged through the mud, should i not have a legal right to put a stop to this??

That is why I suggested mediation.but perhaps you should tell both claimants that because of the stress they are causing you won’t deal with either of them, and that unless they sort it out with each other you will sell the pups to others. Then suggest mediation

i believe i cannot pay the person i was initially in the agreement with due to someone making claim to the rightful ownership of the stud at the time,
This Saturday past i sent an email explaining in detail as what you are suggeting, since i have done this - inhave received threats, also someone was in my yard twice - i believe someone trying to steel my pups, and now i still cannot get to work because of this and its turning my life upside down.
What right do i have with regards ***** ***** name getting slandered and the threats to pay the initial person i had the arrangement with?
I just wanto move on with my life and pay the money over - which i cant as two claimants to this mess, therefore i can give the money to someone to hold it until the day they figure it out, i dont feel it should be affecting me and my family like this

You can also complain to the police if someone came into your yard. If you know who it was, they can be charged with a criminal offence. But I think if they will not agree to a mediation then tell them they must sue each other in court to sort this out and you will respect what the judge says. If they defame you you can sue them for defamation but that is an expensive option
