Customer: I was involved in a car accident, I had no insurance and the other person did. They have send me a couple of emails asking proof that I'm not liable. I always said I feel I'm not the only one liable for accident and I have send them photos of why I said so. Today after 3 weeks or so they send me an email saying that after everything I am liable and have to pay her vehicles full expenses. If not paid within the next 4 days it will be referred to their legal team. Is there any advise you could give me even on how I could go about to pay it off? Thanks

Customer: I have only send them the emails and I have spoken to my brother in law who is a lawyer in SA who assisted with some of the emails to the insurance company and he recon I will have to pay if I don't want to carry any extra lawyer cost as well.

Customer: I can send me communication emails if that will help?

You can negotiate payments with the insurance company. I would suggest you set out your income and liabilities to prove what you can pay each week or month and make them an offer based on that

Will I be able to still convince them that the other party was just as guilty and maybe they should carry half the cost?

Just thought I'll get something this way rather than spending any additional cost.

You can explain your version of the accident and see if they will accept reduced liability. If they won’t negotiate you could suggest taking this to the Disputes Tribunal and the referee would decide liability and also payments. You don’t need a lawyer there
