Customer: Hi , I used to be an RFA working ad a sub contractor. I was given a License agreement which I signed but never received a copy, I have now left 2 yrs a later ( after being paid and receiving trail commission as per the agreement). He now says he can’t find the signed contract and the exit agreement part is up in the air.
JA: Have you discussed this with a manager or HR? Or with a lawyer?
Customer: the deal was I owned 70% and he 30 of all the clients I generated and he is refusing to buy them off me and saying there is no one out there wanting to buy them. But he is also not sharing an documentation of my clients and he’s cut off my phone so I have no client info at all HELP
JA: Are you an "at will" employee? Do you belong to a union?
Customer: There is no HR person ( well his wife) and no not with a lawyer
JA: Anything else you want the Lawyer to know before I connect you?

i am sorry to hear about your situations. Oral contracts can be enforceable as well depending on the situation. And you may be able to "prove up" a written contract that has since been lost/destroyed. Your prior payments, work with the company, emails, etc. can be used to show the contract. So in situations like this is may be best to get a lawyer involved to enforce the agreement. Sometimes even a simply letter or phone call can get the other side to settle and abide by the agreement. In this issue you have been paid the commission owed but is your issue that you either want the clients or their value? If you just want the value of the clients paid, then you would need to work out the value and ask him to pay. If the value is under $30000 you could bring the claim your self in the Disputes Tribunal
