Customer: Hi. I would like to know can I sue a car insurance company that made a fraudulent and unreasonable claims from me? The incident was happened last year, when I reversed my car , the protruding towbar of my car knocked the back car's front bumper grille and caused one of the plastic small joint broken. I took the photo of the broken grille and requested for a quotation from one of the workshop , with a replied it cost $200 to repair . After a month I recieved an email from the insurance company with an invoice for the replacement of a new bumper . I felt very unfair with the treatment, the car is a 5 years car and the photo shown that there is pre-existing scratch on the bumper . I have been mentally disturbing since the incidents and insonmia due to the stress and unfair treatment. The small joint can be even DIY glued it but they changed the whole bumper and wanted me to pay the bill. Can I sue the company for this reason?

You cannot sue the insurance company although you can challenge the claim and say it was excessive. The place where this is done best is in the Disputes Tribunal where lawyers do not appear and the costs are low. You are liable for the damage because you were reversing and the principle when reversing is that you have a much higher duty of care.

Hi Chris , I am aware that I am liable for the damage and i am willing to pay for the repair . The problem is they didn't opt for repair , they changed the whole bumper and charge me for the cost. I have been in mentally disturbance and stress over this matter for almost a year that caused me insomia because of their fraudulent action. Why can't I sue them over this matter?
