Customer: hello my name is***** i am wondering if i can get a free lawyer for my grandson, Tremaine Blackwell who is 13 and
JA: What state are you in? It matters because laws vary by location.
Customer: Tremaines mother kicked him out of her house, 29th Jan 2020 in Christchurch, after his first day at his new school ,she is an angry woman, hes been traumatized, i managed to get him into the boarding establishment at the school.
JA: What steps have you taken so far?
Customer: He is at St Bedes College, he has been seeing a school councilor. He has been staying with me during lockdown and last school holidays. His mother has been threatening him via text and voice messages to take him out of school. Its all about her and she never asks how he is. He is scared of her and does not want to visit her nor stay with her during school holidays. She is very manipulative, she is very good at putting on charm in public and tells lies about Tremaine.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: She had agreed earlier on to give him time and space in early Feb, but within a week she was on the case again with threats.

You could apply to the Family Court for a parenting order that he lives with you and you could get Oranga Tamariki involved to investigate if you think that is needed. At this age he is likely to have views about where he lives when not at boarding school, and that could be explained to the court and Oranga Tamariki. If you cannot afford a lawyer you can apply for legal aid.

Thankyou for your reply, i've just got back from my appointment.
Q. if I apply to the family court for a parenting order for my grandson to live with me when hes not at boarding school, how long will that application take for a parenting order?
His father lives in Australia and is married with 3 children under 4yrs old, plus he has a stepdaughter with his wife. Tremaine and I use to travel to visit his Dad twice yearly, now its totally impossible with Covid-19.
His mother is legally his caregiver, but since she kicked him out of his home 29th Jan 2020, she has not financially supported him, I have been paying for all his schooling and boarding fees etc.
He does not want to have anything to do with her. He is traumatized and is scared of her. He has very low self esteem and confidence.
I live near Winton in Southland. Tremaine is at St Bedes College in Christchurch.
His mother is going to stop him coming to stay with me during the next school holidays.

1. A parenting order can take some time-it could be 12 to 18 months

2. If you get a parenting order you can then claim child support from both parents

3. If he wants to stay with you in the holidays then you could start the process and get an interim order for this
