Customer: Hello, I am interested in some advice on to being found guilty and or if customs have intercepted a parcel into NZ that is considered a Class controlled drug as Defined in the Misuse of Drugs Act 1975
JA: What was the sentence on the drug charges? Have all appeals been exhausted?
Customer: Nothing at this stage, given that only a letter from customs has been sent confirming the interception and that it is a Class C type Drug
JA: Have you talked to a New Zealand lawyer about this matter?
Customer: just received this letter in the mail
JA: Anything else you want the Lawyer to know before I connect you?
Customer: not at this stage and yes if you can connect me that would be good please

This can depend on what sort of drug was on the parcel. It also depends on the quantity and whether there is enough for the presumption of possession for the purpose of supply. For a class C drug, small amounts will usually attract a fine or community service but it does depend on previous convictions and the nature of the drug

Benzodiazepines

First offense sorry

I assume you did not have a prescription for these. As a first offender this is likely to be a fine or community work. At the worst it could be home detention, but unlikely to be jail

Customer
no prescription

I expect you will be asked to give a statement to the Police, so you will need to think about the reasons you imported these

Customer
Ok thank you. I am actually inquiring on behalf of a family member, so yes thank we will think about that
Customer
What dollar amount can one be expecting under this circumstance

Chris The Lawyer, Expert

That can depend on ability to pay a fine
