Who are DCC? Why did they cancel? What sort of contract do you have? Are you worried about insolvency?

Hi Chris thank you for replying. DCC is the Dunedin City Council. I operate a photography stall in the Octagon in a market situation. The contract was between the Dunedin Octagon Market and the DCC. DCC pedestrianised the Octagon in a trial called the Octagon Experience. This meant the Octagon was completely free of cars. The market was moved into a building for 2 weeks then for 3 more weeks there was nowhere to trade. What the DCC did was wrong and need to be held accountable and answerable for their actions.
I'm not concerned about insolvency but I do have a lot of stock, near $10,000, that I'd like to be reimbursed for.
I'd like to know if I have a case.

Is the Octogon Market operator taking any action against the council? Was there any consultation about the changes?

No the Octagon market trust is not doing anything. There was no consultation about the changes. A letter from the DCC dated 29th July 2019 confirmed the dates the market was allowed to occupy the quad in the Octagon

Because you do not have a formal contract with the Council, and the market operator is the contracting party, you don't have a direct connection with the Council. There could be an issue with the Council failing to consult adequately about the changes but I do not consider that gives you an entitlement to compensation. If you had a direct contract with the Council this could be a breach of contract, which is why I asked if the market operator was taking any steps.

This gives a new light on my question. I am a member of the market committee and I am aware of some communications between the president and the council but not all. I will know more hopefully around midday.
