Expert's Assistant chat
Customer: Hi there, say if a fight broke out between two people which resulted in serious injuries, but the person who suffered the injury didn’t want to push charges at the time and the two people had worked their issues out between them selves. But 11 and half’s moths later a police officer shows up unannounced and says he’s going to charge someone.
JA: What was he charged with exactly? Are there any upcoming court dates?
Customer: The person wasn’t charged with anything that’s the thing but now 11 months later we have a police officer trying to push this issue
JA: In what state did this occur?
Customer: New Zealand
JA: Anything else you want the Lawyer to know before I connect you?
Customer: If an officer showed up to your property unexpectedly and seen say a gun on the couch for hunting (this person was going out hunting when the cop showed up so he put the gun on his couch) can the cop pop his head through the door and remove the gun from the property than say have you got a gun license?

There isn’t a limitation period for laying charges but if the other person doesn’t cooperate with the police the charge could be difficult to prosecute. As for the gun, the police can require the owner to produce their licence or confiscate the gun if they don’t have it with them

What if it’s not the person you was involved in this incident that pushing this case. What if it’s the witnesses that were inside and missed the whole scenario that’s pushing the case?
Customer
Who was not involved

Those witnesses would not have direct knowledge of the fight, and at a trial your lawyer could cross-examine them on whether they actually saw what was going on. But the police could proceed on their evidence plus the evidence of the injury. It might come down to an explanation of how your friend was injured, which would affect the finding of assault. The injured victim can help on sentencing by saying that he has forgiven you for the assault. If the evidence stacks up, you might be better off pleading guilty and using that evidence that he has forgiven you
