JA: What steps have you taken so far? Have you prepared or filed any paperwork?
Customer: Got hold of plumber who said we had to go to the original builder to rectify. Our real estate agent told us to go to our solicitor. Have contacted builder who was working with us to get a plumber. He is now a bit stand offish and saying we jave to prove jis libility to fix it.
JA: Where is the property located?
Customer: 114a Stratford. There is also issues with a drain not put in on the entrance off the road on the council owned front entrance ... Council co.ing to loom tomorrow said it should have been done..
JA: Anything else you want the Lawyer to know before I connect you?
Customer: I have requested building consents and info.on.property from the council which ill collect tomorrow. I just want to know my rights as a new home purchasers and legal rights in regards ***** ***** surface water in building compliance code.

If this was a new home which you purchased from the builder, then the builder will need to work with his subcontractor to resolve the issue. If the plumber is not in agreement with the issue, you may need to get another plumber to inspect the soak hole and form an opinion as to the liability for the problem.

We purchased the property from real estate agent. We r the second owners. House is 18 months old but they only lived here for maybe 7months.

Under the Building Act and common law the builder and the plumber can still be held liable. cases like this can turn on getting expert evidence as to the cause of the problem, hence my suggestion as to getting another expert plumber to give an opinion as to the cause of the problem
