Chris The Lawyer, Expert

Hi
I am a New Zealand lawyer based in Wellington and will help you with your question today. Please give me a minute to read your question
img

Chris The Lawyer, Expert

Are you in New Zealand? If you are not, the borders are closed to everyone which will make claiming asylum difficult although you can entry on humanitarian grounds
Customer
I'm in Malaysia. I understood that the border are closed
img

Chris The Lawyer, Expert

Why do you need asylum?
Customer
My home country are no longer safe for me and my family. My business has been ruined by the government. There are threats to kidnap my child
img

Chris The Lawyer, Expert

If you can get to New Zealand then you can claim asylum on arrival. But there are no flights at present
Customer
Can I use the refugee quota programme? Resettlement from offshore?
img

Chris The Lawyer, Expert

You could, althoughthst os on hold at present
Customer
Understood. Is the form to be filled the same?
img

Chris The Lawyer, Expert

These are unusual times. Normally claiming asylum has a standard process but with Covid 19 it is very difficult
img

Chris The Lawyer, Expert

The forms are the same
Customer
I know. But I need to start to prepare to make a move
img

Chris The Lawyer, Expert

You will need to prepare evidence of the threats due to political or racial or religious harassment
Customer
How long does the process takes?
Customer
I have all police report
img

Chris The Lawyer, Expert

That is hard to say, but usually 6-12 months
img

Chris The Lawyer, Expert

Sometimes longer
Customer
what if I'm already in NZ, during the process what stand do I have to stay until my application is approved?
img

Chris The Lawyer, Expert

Usually there are places where refugees must stay while the application is processed
Customer
Can a lawyer assist me to fill up my form?
img

Chris The Lawyer, Expert

When you are in New Zealand you can instruct a lawyer. Otherwise you could contact one to start the process
Customer
There is a section in the form where I need to fill a local contact details. What should I fill if I have none
img

Chris The Lawyer, Expert

Say you do not have a local contact yet
Customer
I do not know anyone in NZ
img

Chris The Lawyer, Expert

That’s not an issue. Most refugees won’t have a NZ contact
Customer
Live the part blank?
Customer
leave
img

Chris The Lawyer, Expert

Hi
Customer
How do I submit my application from outside NZ
img

Chris The Lawyer, Expert

You can submit online
Customer
I'm family of 7 including my mother in law, my husband and for 4 minor children. Do I need to fill separate form for everyone
img

Chris The Lawyer, Expert

Hi
Customer
The section on my plan journey to NZ, what if I do not have a plan should I just put not applicable?
img

Chris The Lawyer, Expert

I assume you would fly to New Zealand when flights are available

Customer
but I was thinking to get the approval first before flying
Customer
After becoming an asylum seekers in NZ do I have a restriction to travel back to my home country incase of emergency. I.E death of family member
Customer
What should I write in the statement of my dependant? Should I make the same statement for everyone
img

Chris The Lawyer, Expert

I am not sure if this is consistent with being in danger. If you can return home, then it might be argued you are not at risk. When you complete the forms you should have the same statement because if the family is at risk then you can share that.

Customer
Then can I travel to a third country?
img

Chris The Lawyer, Expert

yes

Customer
Will the NZ government provide a travel documents to a refugee? Or I need to use my current travel documents
img

Chris The Lawyer, Expert

It depends on the type of visa you have-a residential visa would allow travel

Customer
do I get the residential visa immediately after the government grant me the refugee status?
Customer
Will my home country passport still be valid for me to use for traveling?
img

Chris The Lawyer, Expert

Your home country passport would still be valid, but you would normally have travel conditions initially until you were eligible to apply for permanent residency. That normally takes three years

Customer
I have read online that it is difficult for a Malaysian to get approval to be an asylum seekers in New Zealand, any basis on that
img

Chris The Lawyer, Expert

That is correct
Customer
A person with refugee status, how long a person cannot leave NZ in case there's need of travel.
Customer
The residents pass issued to a refugee has indefinite expiry. With a condition not valid if leaving NZ. How long will be the condition? What if there is a need of travel? Is there any option
img

Chris The Lawyer, Expert

You would usually get a resident visa with travel conditions for a period of years and then you can apply for permanent residency with no conditions

Customer
Does NZ border security mistreat refugees like what is happening in Australia?
img

Chris The Lawyer, Expert

No they are better
Customer
Can you suggest a lawyer to assist on my case or should I fill and submit everything myself
img

Chris The Lawyer, Expert

I dont think your case gets any advantage if it is presented by a lawyer but if you are not confident in written English then a lawyer may be helpful

Customer
I'm confident with my English. Can you explain further on my case representation? So it will basically a waste if I hire a lawyer?
img

Chris The Lawyer, Expert

It would come at a cost, although a lawyer experienced in refugee cases may have useful advice on strategy and presentation.
Customer
In your opinion, what are the chances in my case? Silent oppression from the government
img

Chris The Lawyer, Expert

I think now is a good time to apply with the difficult security law and riots going on
Customer
Is it wise for me to write to RPO that we can sponsor our own tickets & would be able to support own house rent once Asylum granted.we can able to raise 15k dollar by selling our cars.we would not burden NZ govt.we just need protection to escape persecution
Customer
Will this give a plus point to my application
img

Chris The Lawyer, Expert

That doesn’t add to your application. The principal issue is the need for protection
Customer
Do I need to attach my education certificates in my application?
img

Chris The Lawyer, Expert

Yes, but your primary claim is the need for asylum.

Customer
Do I need to fill in all my expired passport no? Or just the current ?
img

Chris The Lawyer, Expert

You just need the current passport

Customer
Do I need to fill all my travels /holidays
Customer
After ticking No on the box. Do I need to elaborate?
img

Chris The Lawyer, Expert

No
