Customer: Okay, I have my dad who has been accused for sexually assaulting a 3month old baby (his grand daughter). He has been accused by his daughter in law. This is not true and just an assumption based on the nappy rashes and unstable relationship between father-in-law and daughter in law. Now the daughter in law would like to withdraw the case by writing a letter of appeal to the court. She needs my helps to give her some words and help her write. Would I be able to do this since I am the daughter of the defendant?
JA: What steps have you taken so far?
Customer: I have just spoken to daughter in law over the phone.

Once the charge has been laid in court it is difficult to stop the process. His lawyer will need to discuss this with the prosecution and see if something can be negotiated to bring the case to an end

Thank you for your reply. Yes the lawyer has requested the prosecution and the person who made the complaint has been asked to write a letter, get it witnessed and present it to the magistrate. Now she needs my help to re word it for her. Would I be able to do this as I am the daughter of defendant and sister in law of the accused?

You can help her prepare the letter. Do the prosecution want this as an affidavit? That is a statement sworn in from of a JP or lawyer

Does this sound right?I was not in my right mind and reacted at the spur of the moment to make a decision which l later regretted that it was not the right one for my baby and her grandparents.I may have over reacted by seeing the nappy rash on my babies body and because of the unstable relationship with my in-laws, I retaliated in confusion and anger and made a complaint against my father in law. I would like to withdraw this case and do not wish to continue further.

Your relationship doesn’t really matter. It is the acknowledgment by the complainant that is important. I am not sure that is the full answer because usually a charge like this would need a hearing or the prosecution would need to agree to withdraw the charge
