Hi, I have a question regarding human rights violations and discrimination for a tertiary bachelors course that will lead to a job later on
JA: Was there discrimination based on age, race, religion, gender, or disability?
Customer: disability and health in relation to the covid vaccine
JA: What kind of workplace is this (private sector, public sector, etc.)? How many employees?
Customer: I am in the process of applying for a Bachelor of Nursing at Whitireia in Porirua NZ.
I have always wanted to be a nurse, however due to current restrictions in NZ for DHBs and healthcare, covid vaccinations and boosters are very much still mandatory. I am currently applying for a vaccine exemption after having suffered from adverse reactions from the 2nd Pfizer dose. Having conversed with staff in the social service and health department at the polytech, they have said that and I quote from previous correspondence,"I am writing in response to enquire about a medical and/or spiritual exemption for COVID 19 vaccination and the implications for studying to become a registered nurse.I refer you to the information provided on our website:This qualification is covered by the COVID-19 Public Health Response (Vaccinations) Amendment Order 2021. Students are therefore required to be fully vaccinated, including a booster dose, as they will have frequent contact/engagement with those providing health services and are considered tied to a role within a healthcare setting. Further information can be found in the health screening section below.Students that hold a medical exemption that prevents them from being vaccinated are permitted to work in the healthcare sector but will have limited placement opportunities in that sector. If you hold a medical exemption, or if you are unable or unwilling to provide proof of vaccination, your placement opportunities will accordingly be limited, and placements cannot be guaranteed. If this applies to you, we encourage you to contact us to discuss your options.Bachelor of Nursing | Whitireia and WelTec (whitireiaweltec.ac.nz)

You will note that there will be limitations in terms of clinical learning. At present we do not have any clinical learning placements that will accept students who are not fully vaccinated including a booster. Clinical learning makes up a significant part of the nursing programme with placements in all three years of the programme. You not be able to complete some courses without completing the clinical learning experiences".In other words, I can't pass the course because I'm not vaccinated.
This I belive is discriminatory against my personal beliefs and medical and educational needs, and a direct violation of human rights.
JA: The Employment Lawyer will be able to walk you through that. Have you talked to a New Zealand lawyer about discrimination?
Customer: No I haven't. I wasn't sure where to go and if this was a legit issue as it only happened today via email.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No, that is everything. Thank you

I am the "complainant" In a court case for non violent breaches of a protection order, however the police have added breaches that are not true and correct as additional. I have spoken to the Detective in charge and the crown prosecutor, however they are not listening to me. With the additional charges it looks very severe to the judge, as she can only see what's I'm front of her. I have written two letters with my safety plans/support and thoughts however I feel that as they keep saying I am the complainant in this matter, the additional charges should not be fictional and should I be getting a lawyer so that my voice and concerns are actually heard by the court. He has been imprisoned for 5weeks on remand, then was out on 24 hour bail for a week, until the police appealed that due to his place of residence being in the same city as me... so went back into remand? This is honestly so much more stressful and traumatic than the reasons I had a protection order in the first place
JA: Is there ongoing abuse or harassment? How recent?
Customer: No. Last one was in June. He was under the influence of methamphetamine and then engaged with an aod counselor to get help but then went back into prison. I have worked with people that have addiction s for the last 5years, so put forward my view that he has bail conditions to continue to engage with services so he does not relapse, as it was the primary concern for me
JA: Were the police called? Was there an arrest for violating the protective order?
Customer: Yes
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I guess I just feel that we were together for 14 and a half years, and he needs help and support and it's better if he has that in the community. They have put in place a non association order which I asked to be withdrawn but they said no... so I'm starting to feel like I'm doing something wrongCustomer: Chat is completed
