Welcome and thank you for using Just Answer. My name is ***** ***** I'm the attorney who will be assisting with your legal question. So I can best help, you've spoken directly with your lender?

Customer
but he doesn't answer my calls anymore

I'm so sorry! They would have to respond to you and provide you with accurate statements of your last payments. To foreclose, it would also have to come from your lender.

Customer
II only speak to one person who states he is the manager & the only one who can help me. I have not gotten any statement reflecting my cash payments I have made
img

Eanderson032, Expert

That is highly concerning. Especially since cash is untraceable.

Customer
He had me get money cards from Walmart & load each card with $500 I have copies of each front & back of cards as well as receipts
img

Eanderson032, Expert

That right there is a clear indication of a scam.

Customer
My modification packet was approved but I was never told it was until he asked for another $1,500 first

A third party can't modify your mortgage. Only your lender.

Customer
Ok well he said he was from my lenders office

Eanderson032, Expert

May I ask, who is your lender? Which bank?

Customer
Rushmore Loan Management
img

Eanderson032, Expert

***-***-**** is their actual number to speak with them.

Customer
I had been speaking with a Mr Greg Adams who is a mgr but a different phone #
img

Eanderson032, Expert

I believe it may be a scam.

Customer
Friday a notice of Trustees Sale was taped to my door with blue duct tape
img

Eanderson032, Expert

You would get a notice of intent to foreclose before that.

Customer
No I haven't gotten that just for the sale on Dec 14th
Customer
I filed a complaint with the Better Business Bureau
img

Eanderson032, Expert

Sadly, the BBB don't have any enforcement power. You could contact the state AG.

Customer
The mortgage loan was with Shellpoint and for some reason Rushmore bought it. I called Shellpoint & they couldn't tell me why
Customer
should I call Rushmore at the phone # you gave me or find a local Atty

Eanderson032, Expert

You may want to first check with Rushmore, then for a local attorney, http://www.avvo.com is excellent.

Customer
Ok thank you for your assistance
