Customer: I am a 100% disabled veteran. I applied for a VA loan and remortgages through New Day USA! My payment is $1020.00 a month! For the last 2 months they have taken 2 payments a month. When I call them and demand my money back they tell me they will send the request! I am told it could take up to 7 to 10 days but they stall when I call them out and then tell me they will resub it and it'll take 3 to 5 business days.
JA: How long has this been going on? What have you tried so far?
Customer: I am on a limited budget and can't afford 2 months. It has happened Sept and Oct! They took the second one for this month on the 10 October. That IA how long they have kept it. They finally told me this past Monday it would be beck in my account today!! Guess what? They lied again! This has got to stop. They tell me, "It's a good thing cause I won't owe another payment till Dec 1st! I have NEVER been late or delinquent since I've had the loan! Sorry I am so long winded here!
JA: Anything else we should know to help you?
Customer: Not at the moment. I mentioned I was going to consult an attorney and I was told if I do it will delay the refund that much further!
JA: OK. Got it. I'm sending you to a secure page to join JustAnswer. While you're filling out that form, I'll tell the Expert about your situation and then connect you two.

No. None

You can request your bank stop any double debits from occurring. They also can be sued if it continues.

Customer
I am not pushing any agenda but 3 1/2 weeks ago I woke up with chest pains, and irregular heart beat. It was early in the AM and wife called an Ambulance. Result my heart was not firing correctly and put me in a monitor for 2 weeks. About a week after that, my wife went through the same exact thing with a monitor! The stress of this is overwhelming.

I'm so sorry! The fact they know you are a disabled veteran and this is causing physical distress can be used against them if you need to sue.

Customer
When we are cut $1000 we are screwed for the next 2 weeks!

They also have a duty to only deduct what is owed.

Have you contacted the VA, since they recommend them?

Customer
No, not yet! That was my plan for Monday! When New Day told me, again , it would be here today, I, like an idiot, held off! I have an appointment with my doctor next week so I was going to do both at the same time!
Customer
I was told this past Monday that if I was going to see a lawyer it could hold it up and they couldn't say when I would get it!!
Customer
My son did some research for me and as far back as 2019, new day had the same issues!
Customer
I cannot believe I am so special that I am the only one!

You could reach out and see if someone is interested in a class action.

Customer
How could I do that and how would we determine the specifics?

http://www.avvo.com is excellent for a local attorney. You could then discuss the possibility of larger claims with more people.

Customer
Will I still be charged the $59 for the phone call?
Customer
I understand the concept of the CA suit! That very well could be the way to go!
