Customer: My wife is cheating on me with a retired soldier, isn't that trouble for the soldier?
JA: Are you overseas or stateside?
Customer: Stateside
JA: Have you talked to a JAG attorney about this? Or anyone in the chain of command?
Customer: No.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I have a feeling he left his military wife for my wife. We're still married. We're not divorced yet. She's been pretty blatant about it

Hello, and welcome to JustAnswer, my name is Henry. I am an attorney with JustAnswer and I will do my best to assist you with your legal question. I am sorry that you are going through this difficult situation. JustAnswer is an information website. We do not provide legal representation or referrals and no attorney-client relationship is formed. Please allow me some time to review your question, and research your answer, so that I may better assist you. I may also be assisting another customer now or between responses but I will get back to you soon.  Is your wife in the military?  You said he'd retired, correct?  Was the affair going on while he was still in the military?

Customer
I'd have to reach out to his ex wife. But I think he's retired. My wife says they've been talking since August. I think longer and I think they may have left each other's spouses for one another
Customer
She's really rushing to get everything done and move to Texas with this guy. I was just made aware of this around January 14

If either of them are in the military then this could be prosecuted as a military crime.  But since he’s retired that likely not the case.  I’m sorry that she’s rushing the process. Jut because she want’s to rush does not mean you have to.  Has she filed for divorce?

Customer
Not yet but soon
Customer
Can you find out if he's retired
img

SuccEsq, Expert

No.  I can’t find that out.

Customer
Is that private information? Could I look into it myself?

Customer
Well, can she file a parenting plan without me? She's moving to Texas. I may move to Texas to be close to my kids.
Customer
We agreed to handle things out of court. I trust her but it feels weird. I feel like she's doing a lot of things behind my back

Yes, either parent can petition the court of a parenting plan.  Notice has to be given to the other parent giving that parent an opportunity to respond.

Customer
She would have to notify me?
Customer
if she doesn't?
img

SuccEsq, Expert

Generally the court won’t proceed without proof that the other parent has been notified.

Customer
I don't have a lot of money. So we agreed to do it ourselves. Now she's trying to milk me for money. If I spend a bunch of money on legal fees, I won't be able to move on and be able to support my kids. She doesn't wanna do 50/50.

I am sorry that she’s taking that position.
