Hello, thank you for using Just Answer. My name is ***** ***** I am the attorney who will be assisting you with this question. I am a fully licensed attorney with over a decade of experience representing clients. Please remember that this is an informational service only, so the answers that I provide are not given as official legal advice and this does not create an attorney/client relationship.

What can I answer for you about VA benefits?

Customer
I hired a law firm to represent me in a VA Claim due to Agent Orange exposure - my late husband died at age 47- this was 3 days after his 47th bday. anyway, I have been fighting with the VA since 1999. I was just recently issued a favorable decision and was deposited over a quarter of a million dollars into my account. is this recent law firm who did not submit on behalf entitled to 33%
Customer
after the deposit came, I respectfully ***** ***** and they had no record of it stating that they didn't even have a fee schedule
Customer
my question is simple. do I owed them a 1/3 of my award despite them not doing anything
img

Geoff, Expert

No. Not unless you had a signed contract with them stating that they were to get 1/3. Were they doing anything for you during this whole time?

Customer
my apologies, the VA informed me that their decision was not based off of a lawyer
Customer
no
I just hired this firm 8 weeks ago they submitted nothing ony behalf

Geoff, Expert

Thank you. Then, no. They are required to only charge a "reasonable fee." If they have done nothing for you, then it would be entirely unreasonable for them to take 1/3 of the money.

Customer
I agree
and I am happy in paying the fee but I just want to be prepared in the event that they tried to charge 33%

Geoff, Expert

If they try to do that, then you need to get your state's bar association involved for an ethics complaint.

Customer
you are the second atty that has told me this. I just needed reaffirmation. thank you again for your time and assistance
again, I have no problem in remitting payment for representation but I don't feel like a third would be fair being that I've basically done the leg work since 1999
