Hello and welcome; My username is ***** ***** and I will do my best to assist you during this time. I have helped thousands of satisfied customers here on Just Answer and am a licensed attorney.

I understand that legal issues can be confusing and intimidating so I will do my best to get you the requested information. This site was created to help provide information to people that need a quick resource when they have important questions! We do our best here to be there for you!

Please be patient as I prepare a response. You can trust that I will do my best to get you the information you need. You may receive an auto generated phone call offer from the site or you can request a phone call if you would like- the site will process that request and a phone based attorney will be calling you shortly. And I of course am more than happy to assist you on this page.

Per the rules of the site, all information is for general educational information only and of course a meeting with a private, personal attorney is required to obtain legal advice specific to one's situation.

Thank you, ***** ***** a few minutes please as I review your question in detail and prepare a response! I look forward to helping you and I hope you will find this site helpful!

I am so sorry; since they have a zero tolerance policy and illegal use can result in dishonorable discharge unfortunately I am not aware of any way to upgrade status.

A dishonorable discharge disqualifies a person from VA benefits; please see

https://sgp.fas.org/crs/misc/R42324.pdf

I wish I had better news but the military and the federal government still have these archaic laws that are quite punitive.
I am so sorry.

Please let me know if you need further clarification otherwise I certainly wish you the best on this. Thank you for allowing me to assist you today. Should you have futher questions please don't hesitate to reach out to us here at Just Answer. If you request me I will do my best to get you the legal information you need. Here is a direct link for that https://www.justanswer.com/law/expert-legalgems/ If you decide that you need help applying that information to the specific facts of your case, you can contact the state bar for a referral to a lawyer for an in person consult and they can assist with anything beyond the general information the site allows us to provide. And of course feel free to use your membership by asking any questions to experts in our other forums such as AUTO, MEDICAL, VET etc! Our Just Answer Professionals strive to get the requested information in a prompt manner! Thank you, ***** ***** very best to you. If no further questions I certainly wish you and yours a Safe and Prosperous 2022! Thank you!

I am not aware of any cases that have a favorable outcome on this; given the zero tolerance policy I am not sure how that would result in a favorable outcome

They are supposed to offer rehab but they can also discipline for the use, so a dishonorable discharge can be part of the punishment.

You may wish to have a military lawyer review your file to see if they see any issues that may give rise to a claim but they normally must be filed within 15 years; please see

Thank you kindly. I try and provide as much information as possible to the customers of the site, so I wanted to get you some information on how to hire an attorney should you determine that is necessary

Here is an article from the American Bar Association on how to hire an attorney, as well as a link to their referral program;

https://www.americanbar.org/groups/legal_services/flh-home/flh-hire-a-lawyer/

Many people find that useful.

This is very important as it explains how billing works

https://www.americanbar.org/groups/legal_services/milvets/aba_home_front/information_center/working_with_lawyer/fees_and_expenses/

I definitely hope all this information, as well as the information provided earlier, is helpful.

Please remember a personal attorney should always be consulted because the site only allows for general information for educational purposes only, per the terms of service.

Should you need further assistance, be sure and reach out to us here at Just Answer and we will do our best to get you that information!

As always, thank you for allowing me to assist you. I would be flattered if you considered requesting me for future legal questions. Here is my direct link:

As a reminder: estate planning should be reviewed annually or whenever there is a significant life change, so please feel free to explore the estate law forum should you have need for that! We also offer experts well versed in medical, veterinary and auto among other popular categories!

Have a WONDERFUL and of course a Safe and Prosperous 2022!

I hope this site has been helpful as I believe in providing affordable legal information so that one can decide if they need to pursue the issue with a personal attorney. If you have a Membership with the site I hope to hear from you soon should you need further legal information! And if you have other topics you need information about- whether VET, MEDICAL, AUTO, TECH JUST ANSWER will have a professional to assist with that question!
