Are you making payment on the property?  Or is there a set closing date?

Customer
Payments
Customer
I should be paid in full in the next couple days
Customer
He has physical hurt me several times and is threatening again over this money that I have not gotten yet and money makes people do bad things so I'm very scared
Customer
The insurance policy has only my name and the land contract holders on it he has come in to my restaurant and shut my gas off and electric several times threatened my employees and I have lost business due to this but no one would help even though his name was only on the building not the business now the fire has totaled the building and he wants too

Why was his name not on the insurance for the building?

Customer
I'm not really sure why he didnt have his name on it. he was present when I got the policy and as far as I know he could gotten his own policy anytime to protect his portion of his asset

And do you plan to use the insurance proceeds to rebuild the restaurant?

Customer
No
img

KP-Esq., Expert

I see.  The insurance company is not going to cut the check to someone who is not on the policy and who has not been paying the premium.

Customer
I was gonna but he has been horrible to me and I just don't want to deal with him anymore
Customer
Correct he said I have to pay him as he knows that check will be made to me and the land contract owners
Customer
Land contract people will be paid I only owe 5000 dollars left on the contract
Customer
My contents portion of the insurance should be arriving any day
img

KP-Esq., Expert

Did he contribute to the premium payments for the insurance?

Customer
No
img

KP-Esq., Expert

OK.  If it is your policy and he did not pay into the insurance, then the proceeds from the insurance payout will go to you.  You can then use that money to pay off the land owners.

Customer
Money came from the business ran as a sole proprietor
Customer
Do I have to pay him for half on the building loss
img

KP-Esq., Expert

Was the insurance for the business or the building?  Did you have separate insurance on the building?

Customer
I had one policy plus workman's comp
Customer
Had business lose and building insurance I think all together
img

KP-Esq., Expert

OK, when the insurance company makes a payment to the insured, the insured is generally not required to provide those funds to anyone else or to use those funds in any specific way.  It sounds as though this individual was not listed as an insured on the policy and did not carry his own insurance.

Customer
That is correct
Customer
But I didn't know if I have to pay him myself if I don't want to
img

KP-Esq., Expert

It's your policy and you are the only insured listed so the money is yours.

Customer
Thank u

You're welcome.  Do you have any additional questions about your insurance policy?
