Customer: Hello , I had a Illinois title Loan in 2020 yr and the company since then , located in Lansing Illinois moved closed down the business and moved due to state regulations however I have been making my payments through phone with them all the way up until December of 2021 and my contract maturity date was due online 16:22 September 1622 however I have not heard from the Illinois title loan by phone by email nor by post master mailing to finish my contract payment so now the date has ended and I cannot find them to get my title return to me due to bridge of contract by them can you help me

Customer: Yes I did I was a resident of Indiana at the time that this all took place except for the year of 2021 and the lawyer has now told me that because I have no longer a Indiana resident with Indiana driver's license they cannot help me I have now just spoke to my current residence of Ohio State and she has informed me to talk to Illinois attorney general to see if you all could help me seeing that it was an Illinois title loan
JA: What steps have you taken so far?
Customer: The steps I have took in so far is to contact an Indiana lawyer to help find the Illinois title loan company or whatever they could do that would get me my title returned because of the bridge of contract from the company itself the second step I have done is today I have spoke to the Ohio tax I mean not tax title people and they have informed me to talk to you now so no one can help me at this point I have a automobile fully paid for that I cannot register due to the fact I do not have the title

No, and let me explain, the contract ending date the maturity date is September 16th 2022 which has now passed but because I have not heard from them since December of 2021 through mail phone or email they have it came in default of their own contract so no I have not heard from them had any kind of connection with them cannot find them don't know how to find them etc

So the tricky part? You have to probably go to court to get this lien released.

The law allows you to seek what's called "declaratory relief." This means you can ask the court to make an order that the vehicle no longer is encumbered in this case.

Declaratory relief is a procedure whose purpose is to “set controversies at rest before they lead to repudiation of obligations, invasions of rights or commissions of wrongs.”
To seek a declaratory judgment, you have to prove four things:
1. A bona fide justiciable substantial controversy exists; (whether this lien should stay considering it has matured and the company has gone out of business)
2. The controversy must exist between parties with adverse legal interest as to their present or prospective obligations related to the contract;
3. A judgment would serve as a useful purpose in clarifying or settling the legal issues; and
4. A judgment will finalize the controversy and offer relief from uncertainty
.All this really means is that you are asking a court to determine definitively what each party’s rights, duties, and obligations are before there is a violation (e.g. a breach of contract). It’s important to know that there has to be an actual controversy. You can’t base it on hypotheticals. For example, if a party has a non-disclosure agreement, but one of the parties didn’t sign the agreement, a person may ask the court for a judgment as to whether the agreement is null and void on that basis. By getting a judge’s blessing one way or another, the parties will know where they stand. No damages are awarded; however, it helps the parties basically “know the score.”
