Hi there, are you vaccinated?

Customer
I am going to get my moderna 3rd shot right now
Customer
Plus 2 other vaccines for flu and shingles
img

ToLawyer, Expert

You should be ok, there are no travel restrictions at the moment for a double vaccinated individual. Why are you worried?

Customer
I am on O.D.S.P. and I was told I may be able to get my benefits extended to 6 months
Customer
My address is still active in Ottawa and am still paying rent there
img

ToLawyer, Expert

That is fine, you can travel to the US. Are you worried about the termination of your lease agreement?

Customer
My stepmom passed in October and my dad moved back into his house and needs my help. I am worried about loosing my odsp benifites
img

ToLawyer, Expert

Oh I see. You will not be able to get ODSP if you are no longer an Ontario resident. How long do you intend to stay in the US?

Customer
My Ohio is good till I am out of the country for more than 212 days in a calander year
Customer
For as long as my dad needs me
Customer
I was told I may be able to get an extension for 6 months
Customer
I can fly back home when needed and dad will hire somebody while I am gone
Customer
I need to go get my booster shot. I will be back at 4:00. Thank you for any help you can give me?

ToLawyer, Expert

Unfortuantly, it does not sound like you will be an Ontario resident once you leave (if you are out of the country for more than 212 days in the year), which means that you will no longer be eligible for ODSP.

You can reapply upon your return.

Customer
I am 61 years old, I have heard that I can get C.P.P.D. and live anywhere on the planet and still keep my benefits that I paid into all my working life? Do you know anything about that option for me to help my father?
img

ToLawyer, Expert

You mean the disability benefits? Do you have a long term disability?

Customer
I do as far as ODSP is concerned but I have heard that I may have to list more things for federal disability such as my broken back and severe arthritis?
img

ToLawyer, Expert

CPPD is not ODSP. If you qualify for CPPD, your ODSP will be reduced by the CPPD amount. The total you get will be the same.

img

ToLawyer, Expert

Have you ever applied for CPPD?

img

ToLawyer, Expert

You were supposed to apply as soon as you develop a mental or physical condition that prevents you from working regularly at any job.

Customer
no I have not
Customer
I thought I did not have to apply till 65 and 60 was optional
img

ToLawyer, Expert

You may want to consider applying anyway to see if they will approve you. https://www.canada.ca/en/services/benefits/publicpensions/cpp/cpp-disability-benefit/apply.html

img

ToLawyer, Expert

No, you are thinking about the CPP post-retirement disability benefit, not the CPP disability benefit.

Customer
Ok thank you I will apply.
img

ToLawyer, Expert

You need to be receiving your CPP retirement pension for more than 15 months or become disabled after starting to receive the retirement pension to qualify for the post-retirement benefit.

img

ToLawyer, Expert

Great, is there anything else i can help you with today?

Customer
I am still paying rent in Ottawa and can return once a month if that would keep my ODSP benifits going?
Customer
That way I could apply for the CPP for the 15 months?
img

ToLawyer, Expert

No, that is not how residency is determined. It is a case-by-case determination. There is no guarantee.

Customer
who would I talk t about a decision on that?
img

ToLawyer, Expert

You should speak with a criminal lawyer locally, give them the whole story, to see what the potential consequence will be before you make any decisions. There is no solicitor-client privilege on this website, so I cannot actually represent you.

Customer
I am here doing elder care. My father has stage 4 kidney disease and needs my help
Customer
A lawyer here or back home in Ottawa?
Customer
or an international lawyer, I do know one of them?
img

ToLawyer, Expert

You should speak with your ODSP officer, residency is determined on a case by case basis.
img

ToLawyer, Expert

I did not mean to type criminal lawyer, apologies.

Customer
I have already given her a bit of a heads up when I came here for moms funeral. I talked to legal aid in Toronto and she said I would have apply to head office. That was before my dad moved out of the long term care home and back to his house. I kind of had to jump ship and come right away to help him.

What did your ODSP offier say?

img

ToLawyer, Expert

Hi there, I am following up on this question as I have not heard back from you. I need more information to give you a complete answer.

Customer
I think your advice of CPPD is my best option. I may hire a lawyer to help me. Let me know if you may like to help me with this and how you may be able to help me with this?
img

ToLawyer, Expert

Unfortunately, I cannot represent clients on this website. The CPPD is fairly straightforward. See if  you can complete the application yourself. You also have to apply online.

ToLawyer, Expert

Is there anything else I can help you with today?

Customer
No thanks I think I am good.
