Customer: A friend is very sick in hospital and just sold his ranch. His Executor and POFA is refusing to dialogue with the daughter also designated PofA. Can they ask a third person to be PofA so in a vote no one is dominant?
JA: What province is the friend in? It matters because laws vary by location.

JA: What steps has he taken so far?
Customer: He (GR) has not followed through on anything ie getting the sick person to sign the real estate papers. 2 Female lawyers have handed the file back because of his disrespect. Now looking for a third active lawyer. He (GR) is a retired lawyer. When the daughter encourages him to get her Dad to sign he dictates to her and treats her as his secretary.

Customer: GR told the female real estate person he did not want to deal with her so she should appoint a man to talk to him(GR)

Please note that I am working from my computer and not actually texting. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

Finally, although the site offers a call option I personally do not take calls but just work online. Some find this confusing as it looks like the offer is coming from me but that is just how the site presents the offer and it really isn’t coming from me. Is your friend mentally competent right now?

he is but has kidney failure and breathing is difficult. He gets muddled when tired

If your friend is competent he can sign documents on his own or he can provide a new power of attorney that would take affect now when he's competent or later when he's not competent. He can revoke any power of attorney that he has already signed.

If he really is incompetent now then someone has to apply to the court to be appointed as his legal guardian and then they will make decisions about his care and finances.

Not really. He is competent and will refuse to change who the Power of Attorney. We are trying to work with the disrespect of the activated PofA. We believe if 2 others are also activated as PofA then the disrespectful person cannot bully the family.
