Please note that I am working from my computer and not actually texting. If you don’t answer back for a while I may not be online when you do but I will never desert you and will check back often. As well, as I am working from home it is possible that I will be interrupted but I will always return back as soon as I can.

Finally, although the site offers a call option I personally do not take calls but just work online. Some find this confusing as it looks like the offer is coming from me but that is just how the site presents the offer and it really isn’t coming from me. Some of the other experts do take calls and so you are very welcome to request a call on this post and an expert may take it. They will have the benefit of reading our exchange which should work out very well for everyone involved!

I know your question is important to you and I will be giving it the time and attention it deserves.

I am sorry to hear of this difficult situation.

If you are the cause of the damage below because your property caused the leak then you have to pay for the damages. If you're in a condo and this is the fault of the common elements in the common elements then the condo corporation has to pay.

Do you see what I mean?

I can't read most of that. I'm not sure why you're showing it to me. If you caused the leak you should report this to your insurance company.

Customer
Okay Deborah what happened was that there was a leak downstairs so the super came to my unit didn't find any water on the floor or any flooding so he called a plumber in the plumber came in and said that my valve was malfunctioning in my toilet and he said he found leaking around my toilet drain which was not true however they're saying that because of my valve in my toilet cause the leak down stairs now this is a matter of opinion thank you know which one I am I'm over here hiding in plain how could they prove that the water damage came from my unit if it did the condensation was coming from the drain pipe between my unit. under my floor and the unit below what I mean is the leak was coming from the pipes inside the building structures

Is this a condo?

Customer
Also can you please tell me how to dispute this matter or what steps to take to take it to court

As this is a condo and if these damages are caused by the  common elements leaking then you aren't liable. So you could sue the condo corporation in small claims court or you can hire a lawyer to threaten a lawsuit or if you have insurance the insurance company may agree to step in and cover you and then sue the condo corporation.

Customer
What are common elements
fgs

Debra, Expert

Common elements are the part of the condo building that the condo corporation owns and you do not own. So if there are pipes in the wall some of them are owned by you and some of them are only by the condo corporation. It's a bit complicated. You should likely see a condo lawyer in Toronto and there are many of them here and they will be able to guide you and also threaten a lawsuit if it's appropriate.

Customer
Okay Deborah one more thing thank you so much

Customer
Deborah one more thing they're saying that my valve was faulty and that was causing the pipe within the common element drain to build up condensation and leaking from there so the source was from the pipe Within the common area of the building not from my unit but so am I so responsible in other words delete the source was coming from common element they're saying that my pointed was causing it so my question is

I provided you with a full legal answer. If you're looking for another type of expert like a plumbing expert you will have to start a new post and say this is for a plumber and then you will get an answer from the plumber.
