My current employer is holding up a medical ei roe, even though my physician has already filled out a medical ei form

Expert's Assistant chat
Customer: Hi There - my current employer is holding up a medical ei roe, even though my physician has already filled out a medical ei form based on my current situation and physical ailment. This is after they refused to follow doctor recommendations. I have not worked in over 3 weeks now due injury. How would I go about this? Basically my work does not feel my current neck injury which includes massive daily headaches and inability to move my head, or sit for long periods of time warrants to leave. Any suggestions greatly appreciated.
JA: Have you discussed the injury with a manager or HR? Or with a lawyer?
Customer: Have discussed with a 3rd party medical advisor for company and immediate supervisor. Not a lawyer.
JA: Are you an "at will" employee? Do you belong to a union?
Customer: At will. No union.
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: No

If you require your ROE, and your employer has not provided it, and you have asked multiple times, you should contact Service Canada.  A Service Canada agent can tell you how to get your ROE or what else they will need to complete your application.

You can find out additional information on obtaining an ROE here: https://www.canada.ca/en/employment-social-development/programs/ei/ei-list/reports/roe-guide/understand.html

If you feel your employer might deny you, or are still uncomfortable with the process, I would recommend that you contact a lawyer in your province.  You can review the law society's suggestions on how to find a lawyer. Depending on where you live you may be able to consult with a lawyer for $25 for the first half hour:

https://www.lawsociety.bc.ca/lsbc/apps/lkup/mbr-search.cfm

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.

Here's the link to their website:

Does that help as a starting point?
