Customer: Hello, my sink is blocked and sometimes the tap doesn’t close perfectly because of this my washroom leaked on the night of September 09. It was leaking little downstairs. Downstairs there is kitchen right under my washroom. There was already a crack on the kitchen roof and because of the leakage it got wider and after 4 days it got worse and cause at-least half a foot of damage on the roof

Customer: It’s in Hamilton,Ontario. No one consulted attorney yet but landlord came to my room last night asking to pay her 1000$ for the repair. She said her friend will fix it for lower cost as if she get it fixed from outsider it will cost us 3000 $. I asked her to give me reciept of bill for the repair after it gets repaired . She refused
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: we didn’t had any lease or any kind of agreement signed. Me and my boyfriend came in april rented for april and may and because of the COVID-19 we got stuck here and paying her month to month rent

Customer: I complained the landlord about the blocked sink and tap two times verbally and one time she came in with a drainer only for the sink which doesn’t help. She did no maintenance for the sink and there has also been problems of upkeep before which i complained to her many times but never got solution

I am sorry to hear about the problems you are having with your rental unit.

If the damage to the kitchen ceiling is due to the blocked sink and dripping tap which your landlord did not repair, your landlord should be the one to pay for the repairs to the ceiling.

Plumbing problems which are not due to your negligence ( such as putting inappropriate items into the sink or toilet) are maintenance issues which are the landlord's responsibility.

I would suggest that you tell your landlord this and if she insists that you pay, you can file an T6 Tenant Application for Maintenance to the Ontario Landlord and Tenant Board to have them order your landlord to make the necessary repairs.

In that case, the landlord and tenant law does apply and you can go to the Landlord and Tenant Board with a T6 Application.

If i want to leave next month there is no need to go to the Landlord tenant board? . . I sent my landlord a written detailed notice.

If you want to move out, you have to give our landlord 60 written notice and the last day should be the day before your rent is due. You do not need to go the Board if you give this notice and want to move out.
