Customer: My wife is anticipating to get a student Visa? to come to Canada for her masters degree and as her husband, I am working in another country with a work Visa. If she joins me here with the children in this foreign country, which the country permits and legalized. Can she process her Visa from this foreign country, if the admission clicks shortly after her stay with me or she must go back to our country to do that. Secondly if we decide that our four minors should accompany her, Canada being with better education and I being a man and busy, does Visa office have any right to deny them Visa, if all obligations fulfilled. If they do , can one involve the expertise of just answer legal department.

Are you asking whether your spouse can apply from within another country where she is a visitor?

Well here if you have iqama, residential permit, you can stay , as long as you want. There is no PR in Saudi Arabia. If she comes and get iqama which qualifies everyone to stay, as long as she wants but renewable yearly. So I suppose she will be termed a Saudi resident except in law she will be categorized as visitor. If she comes to me here, she with have her residential permit, Iqama, she will stay as long as permit is renewed, which is automatic if one wants. However it is noted that it's work Visa that brought me to Saudi. When the anticipated Canadian admission comes, can she apply for Visa from here with the kids, being our country of legal resident or she has has to go to our home country to apply. That is really want I want to clarify.

She can apply from SA as she is not there illegally. That is really the only requirement.

She will be on your study permit so that makes things even clearer for Canada Immigration.

There is no reason that she and the 4 kids could not come with you so long as you can show sufficient funds for living expenses for the 6 of you.
