Customer: Hi so ive been in an accident involving my car and a garage. The garage is in an underground carpark of units that my friend lives at. Shes told me she has seen footage but i have reason to believe shes lying. I did not approve of any quotes nor was i involved in any of the repairs process. Im wondering if because i did not approve anything and she did if i am liable if this goes to court?

Hello
How did the accident occur? Were you at fault and now simply disputing the quantum (fancy legal word meaning amount owed) to repair the damage?
If so, then no, you not being part of the repair process does not stop you from being liable.
All you can do is negotiate a settlement. Either,

1. Obtain a counter estimate of repairs from another tradesman

or

2. offer partial sum of what your friends is claiming.

Is the garage not under strata? Why is your friend not seeking an insurance claim through the strata insurer and you can simply pay the insurance fee?

I wish to help you in this situation.

I was reversing out of a spot and hooked too much and scrapped my car against the garage. As the spot was in the corner. Yes at fault and disputing quantum. Even if the repairs have been made? Ive offered a partial sum and shes refused. It should be under strata but wouldnt her property manager have done that already?

Ok, so liability is there.
Secondly, repairs made, strata wont act now.
She is at liberty to sue you sadly.
I would offer her say 75% of the claim. She will not be able to get anything higher in Court.
How much is she asking for?

Customer
The entire amount. I said to pay 1.5 and she refused.
Customer
How do i approach her about it

How much is the entire amount i mean; $ wise?

Customer
3.2k total

Wow, seems incredibly high at first blush.
However.. It's all a court can go off, unless you have anything countering that estimate. A court cannot simply say 'that's a bit high' all they can do is go of evidence sadly.
Without anything to the contrary, the amount needs to be paid.
Customer
do i offer 75% of the cost and leave it at that? What if they dont have evidence of it being me

Daniel, Expert

Well they do have evidence, you said y o u did it and offered to pay.
That admits liability.Offer 75%, as a court would accept that.I wish to help you in this situation. Please click accept / rate my service (WITH THE STARS - FINISH BY RATING). I am able to answer further questions after doing so at no further cost to you
