Expert's Assistant chat
Customer: Hi, my son has a friend who is living in his grandparents and he wants to be adopted. H9w is the law we can adopt him if we are only permanent residents. Can we do that?
JA: Do both biological parents consent to the adoption?
Customer: I didn't talked with them yet. Now I would like to know is it possible or not.
JA: Is there a custody agreement or order in place?
Customer: So his dad is not with his family anymore. His mom probably say yes for the adoption.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Only I want to know the process how much is worth for me and also how long it takes.

He's living with his Grandfather right now and the old man not really like him. That what we heard from Jason (the kid name).
I'm not 100% sure this is all true but we know this kid have a rough life.

How old is he?

Will the grandparents agree?

Can you find the father?

Customer
He is 14 years old.
What I said we just know he's story and I would like to know is it possible we can take care of him legally?
He don't know his father. Never met him. I think her mom had him only for a fast love or so.

Adoption means that the rights of both parents are severed fully. You are treated exactly as if you were the biological parents of the child. You will be fully responsible for him for support and for all decisions about him.

It is a huge step for you and for the parents.

You will need to find the father or take all steps possible to find him and you will need to get the consent of the mother or at least serve her and get a court order waiving her consent. If you cannot find the father you can get an order for substitute service.

If the grandparents have legal custody you will need to have their consent or they can contest the adoption.

So it's not simple and you will need to retain a lawyer if you want to get this done. It cannot be done until the courts re-open fully.

If instead of adopting the child you want to have custody/guardianship it will be somewhat easier but you will still need the consent of the mother and possibly grandparents and otherwise again will need to get a court order. If the mother opposes in either case there will have to be a full trial.

You will need a lawyer in Alberta.

Does that help as a starting point?
