Response: That will be fraud and anything you signed because of that fraud will not be legally enforceable because your consent was obtained by fraud. In any event, you do not have to move out at the expiration of the 30-day notice. The Landlord must go to Court and file eviction case against you in order to remove you from the premises.

There is no self-remedy to eviction actions in Kansas. So, the Landlord cannot change the locks or shut off your utilities to force you out. The Landlord must use the Court system to accomplish the eviction by filing eviction action in Court and serving you with the Summons and a copy of the complaint so that you can respond and tell the Court why you must not be evicted or why you must be given ample time to find another place to live. It does not matter what you signed. You do not have to move out at the expiration of the 30-day notice.

The Landlord MUST still go to Court and file eviction case against you if you refuse to move out.

Customer
