Customer: I have have had an ongoing issue with my apartment management about hot water in my apartment. It is sporadic at best. I have complained and been told that it is "just the way it is. The hot water heater is too small for 80 people." I have been very patient about this but it is a health issue, with the virus. And clearly they do not want to do anything about it. I have not wanted to cost them money but I am tired of cold water and if they need to put in a larger hot water heater so be it. A friend sent me a Washington law 59.18.070 which he said references basic services like hot water. Please advise me of my rights

The landlord would be in violation of RCW 59.18.060 as well which says:

The landlord will at all times during the tenancy keep the premises fit for human habitation, and shall in particular:

(11) Provide facilities adequate to supply heat and water and hot water as reasonably required by the tenant;

So you would have legal grounds to sue them under 070 if you wanted to force them to make repairs and they don't take action after you give them written notice first.. It would be a good idea to get a digital thermometer and then take video of you with the hot water only on to show proof of the temperature on at least a couple different days so use as proof in court..

I I Xi forgot to mention that I receive receive a housing subsidy from a public agency and their inspector gave them a report a complaint which they did not respond to

You need to send the landlord a written demand for them to fix the hot water problem and give them 24 hours to make repairs... Send it to whatever address you have for them... regular first class and also certified mail.. so you have proof..

Then if they don't fix the problem in 24 hours, you can sue them in court... In the meantime, get your digital thermometer and start doing video of the water temperature when the hot water is cold...
