Expert's Assistant chat
Customer: I have a small business in Florida. I have been forced to be closed until just recently. I stayed in contact with my landlord and explained to her that as soon as we can open back up I will catch up the rent. We planned to open this week. We went to the office over the weekend and LITERALLY ALL of our stuff is gone. There has not been a formal eviction filed by her through the court. Isn’t this against the law?
JA: Because laws vary from place to place, can you tell me what state the property is in?
Customer: florida
JA: What are the terms of the lease? Any issues related to maintenance or upkeep?
Customer: we had a one year lease. No issues with maintenance or upkeep whatsoever.
JA: Anything else you want the Lawyer to know before I connect you?
Customer: Have a one year lease. The lease isn’t set to be over until October.

Hello and welcome! My name is ***** ***** I am a licensed attorney and will try my best to help with your situation.

.

You will likely be offered a live phone call by the website. It is not from me.

.

If you would like a call, another attorney will provide that service. I only work on the website. and prefer to type my responses so they are in front of you.

.

There may be a short delay in my responses as I type out an answer or reply as I am an actual independent practicing attorney, not an employee of JustAnswer.

.

Yes, that is definitely against the law.... Even if there is a lock out clause in your lease, the landlord can only change the locks and then proceed with a formal court eviction..

.

So you have legal grounds to sue the landlord here for whatever the value of your property is or for its return if they still have it..

.

.

thanks

That's what I thought. Thank you very much.

Do I need an attorney that specializes in real estate law? Is that what you would recommend?

How much money in damages are we talking about here?

Customer
We had 15 Dell computers plus an Apple iMac, 20 cubicles plus chairs, two keurigs, three white boards. Plus much more. I'd say at least 15,000.

Then yes, that is over the $5K small claims limit so a local real estate or civil litigation...even a landlord tenant law attorney could handle something like this..

Customer
I can show receipts for every large purchase. Several brother printers, a $600 paper shredder. I could keep going lol
