Customer: I bought a design (art) on Etsy.com. On the site page the seller gave me permission to use the design on items that I sell. We used the design to make garden flags. I received a letter from an attorney that is claiming that I am using the image with out the permission from the 'original' artist. They are demanding $5,000 in damages.

Customer: No

Customer: I have talked to one lawyer that says for me to ignore the emails until I hear about legal action thru the Federal Court. I do have documentation from the person I bought the design from that I have permission to use the design how I need to.

I concur with the first attorney.  You have no proof this is the actual original owner.  It sounds like the seller you relied on did not have the proper authority to give for you to use the design.  I would stop using it but not really fear litigation.  I can not see a federal suit for the amount in question.  It would be a loss leader and cost more than it is worth in my eyes.
